The recently formed Public Patent Foundation (PUBPAT) has filed an Amicus Curiae brief with the Federal Circuit Court of Appeals in the case of Knorr-Bremse v. Dana Corp. PUBPAT is seeking to overturn the ruling that when a person or business becomes aware of any patent and does not hire a patent attorney a court must presume infringement of the patent was willful, and impose a penalty three times greater than for non-willful infringement. Full details from PUBPAT.org.
