Eben Moglen to Appear as Expert Witness

The Free Software Foundations General Counsel, Eben Moglen, will testify as an expert witness in the case between MySQL AB and Progress Software Corporation. The focus of the case is a GPL violation by Progress Software Corporation. A press release from the FSF is available here. Update [2002-3-3 21:6:40 by jonas]: The FSF has published another press release in the matter here. It talks about the decision from Judge Saris regarding a preliminary injunction.

It should be noted that this isn't really going to prove the GPL in court - NuSphere have basically admitted that they violated the GPL by changing their actions and distributing source.

If this injunction doesn't get granted - and it probably will ;) - that means that the loss of distribution rights after a violation doesn't hold, which may be slightly problematic but not fatally damaging to the GPL at all.

Of course, the other defence is that no violation occured, but I think I stand more chance of winning the lottery....

Does anybody know how the case got so far? Usually companies prefer to settle out of court rather than get dragged into litigation....
